Consequences of a Domestic Violence Charge

If you’ve been arrested on a charge of domestic violence, you may be incredibly concerned about the potential ramifications of such an allegation. After being charged or arrested for domestic violence, it’s likely that a restraining order, or order of protection, will be issued against you.

In the state of Colorado, domestic violence is defined as a threat or act of violence against someone that the defendant has or formerly had an intimate relationship with. The domestic violence charge depends on the underlying offense, such as assault.

Depending on the nature of the underlying offense and the criminal history of the defendant, a domestic violence charge can be a misdemeanor or a felony. If the defendant is determined to be a habitual domestic violence offender, the new domestic violence offense can be charged as a Class 5 felony which can result in a four-year prison sentence.
